That amount doesn't stay with the firm; it belongs to the notary office. The 2% of the property's value, plus a 1x1000 (one-per-thousand) charge, is paid to the registry at the final sale, which is a separate procedure Your lawyer gives you the exact figure before you pay anything, no strings attached.
FAQ
What happens if I reserve the property just by word of mouth or with a receipt?
The owner can sell it to someone else and you're left fighting to get your money back. A notarially authenticated option locks in the deal, the price and the deadline.
Does the purchase option already make me the owner?
No: it's the prior commitment; it secures the deal until the final sale.
How much does it cost?
The professional fee, from $65, covers drafting and notarial authentication; the official notary fee is extra. The final sale and its 2% are a separate procedure.
Where is the option signed?
It's authenticated at the notary office, not recorded at the registry; the final sale does go to the registry.
Is it safe to buy without checking?
No: we always recommend a registry review first, before you sign the option.
About this procedure
Before the final sale, a purchase option is almost always signed: the contract where the buyer hands over a deposit (arras) and both parties commit to closing the sale within a set period, under certain conditions. It sounds simple, but it's where the most people get burned: if the contract is badly drafted, the buyer can lose the deposit with no way to recover it, or the seller can end up tied to a bad deal, or it isn't clear what happens if the bank doesn't approve the loan. Here, every clause is worth money. We draft your purchase option protecting your interests, whether you're buying or selling: we set the deadline, the amount and purpose of the deposit, the penalties if someone backs out, and the conditions that protect you. It's a private document that doesn't always go to the registry, but it sets the rules of the game for the biggest deal you'll make. Don't sign an option from an internet template; protect yourself.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- A purchase option is a preliminary contract; it's usually authenticated at the notary office, not recorded at the registry
- It sets the deposit, deadline and penalties
- We recommend a registry check of the property before signing (a separate service)
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
