FAQ

What happens if the condominium changes the rules and doesn't record the amendment?

The decisions don't hold against owners who weren't there or against new ones: the old declaration prevails. Only a recorded amendment binds everyone.

Can I amend the condominium declaration?

Yes, with the majorities required by law; we draft and record the amendment.

How much does it cost?

The professional fee, from $180, covers drafting, the visado (a lawyer's sign-off, required before filing a document) and recording; the official registry fee is separate, depending on the filing.

Can I change the percentage shares?

Yes, with the majorities required by law and by recording the amendment.

What do I need?

The minutes of the owners' meeting that approved the amendment with the majorities required by law, and the current declaration.

About this procedure

Over time, a building's original condominium declaration (documento de condominio) can become outdated or need corrections: miscalculated alícuotas (each unit's percentage share) that spark fights over who pays how much, common areas whose use changed, units that were split or merged, errors in the original description, or adjustments the owners decided at a meeting. Amending the condominium declaration isn't a matter of crossing out and rewriting: it has to be done in line with the Ley de Propiedad Horizontal, with the majorities it requires for each type of change, and the amendment has to be recorded at the registry so it's valid and enforceable against everyone, including future buyers. A badly amended declaration, or one amended without the formalities, can kill sales and cause conflicts among co-owners. We analyze the current declaration and the change you need, check the required majorities and formalities, draft the amendment in line with the law, and record it at the Registro Inmobiliario (Real Estate Registry) so it's final. We update your building's rules without opening the door to new headaches.
