FAQ
What happens if I lend or finance with the security only in the contract?
You have no real security: if the debtor doesn't pay, you're just one more creditor in line. Only a recorded mortgage gives you priority over the property.
How is a mortgage created on my property?
The security document is drafted in favor of the creditor and recorded.
How much does it cost?
The professional fee, from $150, covers drafting, the visado (a lawyer's sign-off, required before filing a document) and recording; the official registry fee is separate and is calculated on the amount secured.
Can there be more than one mortgage on the same property?
Yes, by rank; the first mortgage gets paid before the second.
Do both parties have to sign?
Yes, the owner who grants it and the creditor who accepts it.
About this procedure
A mortgage is the gold standard of security when someone lends a significant sum: the debtor puts up their property as backing, so if they don't pay, the creditor can enforce that security and collect from the property. It's used constantly between individuals, with private lenders and in business deals, not just with banks. But for the mortgage to truly protect the lender, it has to be properly created and recorded at the Registro Inmobiliario: if it isn't recorded, it's not enforceable against third parties and the creditor is left unprotected. The document must spell out precisely the amount secured, the term, the interest and the conditions for foreclosure. We draft the mortgage document looking after our client's interests, check that the property can serve as collateral, and record it so the mortgage is on file with full legal force. If you're the lender, this is the difference between real security and a mere piece of paper.
